Website regulations
These Regulations define the rules for using the Website available at www.nadmorskilukus.pl and for renting and booking Apartments offered by Marek Hańderek.
Definitions
§1
The terms used in the Regulations, unless otherwise stated, mean:
- Nadmorski Luksus Apartments – Marek Hańderek, with the address for correspondence: ul. Kosciuszko 52; 34-300 Zywiec, e-mail address: kontakt@localhost, phone number: +48 33 861 13 98, +48 792 988 609; being both a service provider and a lessor;
- Service – website operating at: www.nadmorskiluksus.pl
- Guest – a consumer or entrepreneur using the services of Nadmorski Luksus Apartamenty, who is also a party to a short-term rental agreement for tourist, leisure or professional purposes;;
- Consumer – a natural person making a reservation, concluding an agreement with Nadmorski Luksus Apartamenty, for purposes not directly related to its business or professional activity;
- Entrepreneur – a person making a reservation, concluding an agreement with Nadmorski Luksu Apartamenty as part of their business or professional activity;
- Website – www.nadmorskiluksus.pl
- Apartment – a residential unit identified in the offer presented on the Website, which is the subject of short-term rental for tourist or leisure purposes;
- Reservation form – a form available on the Website, through which the reservation of the Apartment selected by the Guest is made;
- Business day – one day from Monday to Friday, excluding public holidays;
- Regulations – these Regulations. In the scope of services provided electronically, the Regulations are regulations within the meaning of the Act of July 18, 2002. on the provision of electronic services (Journal of Laws of 2013, item 1422, as amended) and defines the rules for the provision of services via the Portal;
- Newsletter – uelectronic service provided by Nadmorski Luksus Apartamenty using e-mail correspondence, which enables all customers using it to automatically receive from Nadmorski Luksus Apartamenty cyclical content containing information about news and promotions on the Website;
- Civil Code – Act of 23 April 1964. Civil Code;
- Act – Act of May 30, 2014. about consumer rights.
Stosowanie postanowień Regulaminu

The Regulations apply when booking an Apartment, canceling reservations, confirming them and concluding short-term rental agreements with Website Guests via the Website.
Basic information

- The owner of the Website and the entity with which the short-term rental agreement is concluded for tourist or leisure purposes is Marek Hańderek, with the address for correspondence: ul. Kosciuszko 52; 34-300 Zywiec, e-mail address : kontakt@localhost, number phone:+ 48 33 861 13 98.
- The administrator of personal data processed in connection with the implementation of the provisions of these Regulations is Marek Hańderek. Personal data is processed for the purposes, within the scope and based on the principles indicated in the privacy policy published on the Website. Providing personal information is voluntary. Each person whose personal data is processed by Nadmorski Luksus Apartamenty has the right to inspect their content and the right to update and correct them..
- Nadmorski Luksus Apartamenty declares that it is the sole owner of the Apartments offered for short-term rental, and that it is authorized to provide the services offered.
- The offers of the Apartments and the prices for their rental are for information purposes and do not constitute an offer within the meaning of Art. 66 § 1 of the Civil Code.
- The Website’s guests can be both Consumers and Entrepreneurs who have accepted the Regulations and comply with its provisions.
- Each Guest making a reservation of the Apartment is obliged to read these Regulations. When making a reservation, the Guest confirms that he has read the Regulations and expresses his acceptance in the current wording by checking the appropriate box on the order form.
- Prices for renting the Apartments may change. The Guest is bound by the price at the time of booking the Apartment.
- Nadmorski Luksus Apartamenty reserves the copyright to all photographs posted on the Website and prohibits their use for any purpose without the consent of the author.
- In matters related to the use of the Website, in order to initiate a complaint procedure, as well as any irregularities related to the operation of the Website, the Guest may report it by sending an e-mail to the e-mail address: kontakt@localhost, or by contacting us from Monday to Friday from 8.00 to 15.00 on the phone number: + 48 33 861 13 98.
- The use of the Website is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
- device enabling access to the web browser: Mozilla Firefox version 17.0 or newer or Internet Explorer version 10.0 or newer or Opera version 12.0 or newer or Google Chrome version 23.0 or newer or Safari version 5.0 or newer or Microsoft Edge version 25.10586 .0.0 or later;
- minimum screen resolution of 1024×768 pixels;
- enabling the option of saving Cookies and Javascripts in the web browser.
Apartment booking

- Nadmorski Luksus Apartamenty publishes on its website detailed information about apartments offered for short-term rental.
- Guests can book the Apartment in the following way:
- via the booking form via the Website – the Guest will be immediately informed about the availability of the Apartment and the immediate possibility of booking;
- via e-mail – kontakt@localhost – the Guest will be informed via e-mail about the availability of the Apartment and the possibility of booking..;
- telefonicznie pod numerem telefonu: +48 792 988 609 – The Guest will be informed about the availability of the Apartment and the possibility of booking .
- The apartment can be booked for a minimum of one day.
- The reservation is confirmed when it is assigned a number by the on-line reservation system and provided by phone or to the Guest’s e-mail address. The information provided to Guests also includes an indication of the Apartment rental price for the selected period of time and the amount of the reservation fee.
- The booking fee must be paid within 3 business days of receiving the return booking number.
- If, after the expiry of the periods indicated in par. If the booking fee is not paid, Nadmorski Luksus Apartamenty will cancel the reservation.
- The payment of the reservation fee is a confirmation of the conclusion of a short-term rental contract for the period indicated by the Guest.
- All prices quoted on the Website are gross prices expressed in Polish zlotys (PLN). Nadmorski Luksus Apartamenty is a VAT payer.
- In the absence of confirmation of the reservation with an indication of its number, the Guest should immediately contact Nadmorski Luksus Apartamenty in order to confirm the reservation..
- The remaining part of the fee for the booked Apartment should be paid no later than 7 calendar days before the start of the stay in the Apartment.
- The natural person making the reservation of the Apartment must be at least 18 years old and have full legal capacity. In the case of minors, the consent of a parent or legal guardian is required.
- The booking procedure made via the Website through the Booking Form consists in particular:
- selection of the Apartment and the date of arrival and departure;
- providing the Customer’s data necessary to perform the contract;
- choice of payment method;
- accepting these Regulations;
- consent to the processing of personal data;
- clicking on the button on the “Book” Website or with equivalent content.
- The order is placed by filling in the Booking Form and providing the necessary data for the proper execution of the order (e.g. name and surname, contact telephone number, address, e-mail address).
- The use of the Booking Form begins when the Guest selects the selected Apartment / date of arrival, date of departure. Making a reservation takes place by performing a total of two activities by the Guesti:
- completing the Booking Form;
- clicking on the “Book” or other equivalent button on the Website;
however, until that moment, it is possible to modify the entered data on your own (for this purpose, follow the instructions displayed on the Website).
Methods and terms of payment

- The payment for the short-term rental of the selected Apartment is each time confirmed by Nadmorski Luksus Apartamenty by phone or via e-mail.
- The reservation fee for your stay can be paid as follows:
- using the Przelewy24 fast payment service – by credit card or online transfer, after making a reservation. Regulations for the provision of services by Przelewy24 are available at: www.przelewy24.pl/regulamin
- by transfer to a bank account : BGŻ S.A.: 46 2030 0045 1110 0000 0153 2750.
- The reservation fee is 50% of the rental value and is a non-refundable deposit. The reservation fee should be made within the time limit specified in § 4 sec. 5 of the Regulations.
- The remaining part of the payment for the stay should be made no later than 7 days before the start of the stay, by transfer to the bank account of BGŻ S.A.: 46 2030 0045 1110 0000 0153 2750.
- The price for the stay includes: VAT and tourist tax.
- In addition to the short-term rental fee, the Guest may additionally purchase the Apartment cleaning service during the stay with an additional change of bed linen and towels, unless the offer states otherwise.
- In the event of a stay of up to 14 days, Nadmorski Luksus Apartamenty offers additional paid services:
- PLN 110.00 – cleaning – full version (cleaning service and replacement of towels and bed linen);
- PLN 70.00 – cleaning service.
The above-mentioned services are payable by ticking the appropriate box on the order form.
Changing and canceling a reservatio
§6
- Nadmorski Luksus Apartamenty informs the Consumer that it is not a party to the code of good practice.
- Changing the booking date or the number of people in the Apartment is possible if the given Apartment is available on the selected date. If there is a price difference, the Guest will be informed about it, as well as the need to compensate for it.
- Nadmorski Luksus Apartamenty may not make changes if it is not possible due to the unavailability of a given Apartment.
- In the event of withdrawal by the Guest from the reservation, he is entitled to a refund of 50% of the Apartment rental value, in a situation where the Guest has paid 100% of the rental value before withdrawing from the reservation. The amount paid will be returned to the Guest’s bank account indicated at the time of booking, or otherwise indicated by the Guest, no later than 7 days from the date of cancellation of the reservation.
- In a situation where the Guest does not arrive on the agreed date, without prior contact, this results in releasing the Apartment for re-booking the next day after the date on which the Guest was supposed to start the stay. In this case, the Guest is entitled to a refund of the rental fee t, in the amount determined in accordance with paragraph 4 above.
- Nadmorski Luksus Apartaments may change the Guest’s reservation by proposing another Apartment with the same area and parameters or higher, without having to pay the difference in price, only in the event of force majeure, as indicated in section 7 below, preventing the performance of the selected Apartment rental service. Nadmorski Luksus Apartaments will immediately inform the Guest about the change.
- By force majeure is meant:
- strikes
- war
- natural disasters
- depriving Nadmorski Luksus Apartamenty of utilities: i.e. electricity, gas, heat or water for reasons beyond the control of Nadmorski Luksus Apartamenty.
- If it is not possible to provide another Apartment, Nadmorski Luksus Apartamenty will immediately inform the Guest and return the amount paid for the stay, not later than within 7 days from the date of occurrence of the circumstances referred to in paragraph 6 and 7 above..
Rules of staying in the Apartment
§7
- The stay in the Apartment starts at 16.00 on the first day of the booked date. The Guest collects the keys from the Apartment Manager.
- Check-out takes place by 12.00 on the last day of the booked stay, by returning the keys to the Apartment by the Guest.
- Accommodation in the Apartments is possible from 7.00 to 20.00 at the Apartment Manager. The manager of the apartment is Mrs. Paulina Okińczyc, tel:+48533026535.
- In case of late arrival, Nadmorski Luksus Apartamenty asks for prior contact by phone or e-mail in order to arrange the collection of the keys to the Apartment.
- Check-in after 20.00 on the day of arrival and check-out before 7.00 on the day of departure is an additional fee of PLN 50 (on site at the Apartment Manager).
- Guests staying on the premises of the facility are required to observe the current curfew from 10.00 p.m. to 6.00 a.m.
- The Guest is obliged to use the Apartment in accordance with its intended purpose, and not to make any changes or expenditures on the object of short-term rental.
- Before leaving the Apartment, the Guest should take care to prevent possible damage to the Apartment, i.e. turn off electronic devices, turn off the light, make sure that the windows and doors are closed.
- In the event of damage, the Guest should immediately inform Nadmorski Luksus Apartamenty.
- Pets are not allowed in the Apartment.
- The number of people specified as the maximum when making a reservation may stay in the Apartment.
- In Nadmorski Luksus Apartamenty there is a total ban on smoking and lighting the grill on balconies or terraces.
- If, during the Guest’s stay, a part of the Apartment’s equipment is damaged or lost due to the Guest’s fault, Nadmorski Luksus Apartamenty is entitled to claim the losses from the deposit paid by the Guest.
- The apartments are fully equipped and prepared for guests’ disposal, and guests are responsible for taking care of the property entrusted to them.
Personal data protection
§8
- Customers’ personal data is processed on the basis of applicable regulations, i.e. the Personal Data Protection Act (Journal of Laws of 2002, No. 101, item 926, as amended) and the Regulation of the European Parliament and of the Council (EU) 2016 of April 27, 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) – from the date of entry into force of the Regulation.
- Guests’ personal data will be used only for the purposes of the contract and will not be made available to other recipients. These data are processed on the basis of art. 23 sec. 1 point 3 of the Personal Data Protection Act and art. 6 sec. 1 letter b of the GDPR – from the date of its application. The data will be stored until the Guest’s claims under the concluded contract expire.
- The Guest has the right to access their data and the right to correct, rectify, delete, limit processing, the right to transfer data, the right to raise objections..
- The guest has the right to lodge a complaint with the supervisory authority when he/she considers that the processing of his/her personal data violates the provisions on the protection of personal data.
- The data will not be subject to automated processing, including profiling.
- If the Guest expressly consents, personal data will be processed for the purpose of direct marketing of the services offered for sale. In this case, the Guest has the right to withdraw consent at any time without affecting the lawfulness of the processing that was carried out on the basis of consent before its withdrawal. If the data is processed on the basis of art. 23 sec. 1 point 1 of the Personal Data Protection Act and art. 6 sec. 1 lit. and GDPR – from the date of its application. The data will be stored until the Guest withdraws their consent.
- The administrator of personal data is Marek Hańderek.
- Marek Hańderek declares that before starting the processing, he will take technical and organizational measures to secure the entrusted personal data. Marek Hańderek declares that he has the appropriate means, including appropriate safeguards, enabling the processing of personal data in accordance with the provisions of the Act of August 29, 1997. on the protection of personal data (Journal of Laws of 2002, No. 101, item 926, as amended) – and the Regulation of the Minister of Internal Affairs and Administration of April 29, 2004. on the documentation of personal data processing and technical and organizational conditions to be met by devices and IT systems used to process personal data (Journal of Laws No. 100, item 1024).
Withdrawal from the contract
§9
- The parties have the right to withdraw from the contract in the event of the circumstances specified in § 7 section 7 lit. a-d) of the Regulations.
- In the event of withdrawal from the contract due to the occurrence of certain circumstances:
- in § 7 sec. 7 lit. a-c) of the Regulations, the Guest has the right to a refund of the entire rental value paid;
- in § 7 sec. 7 lit. d) of the Regulations, the Guest has the right to compensation proportional to the service provided.
Privacy Policy
§10
- Nadmorski Luksus Apartments informs that when using the Website, short text information called “cookies” (hereinafter referred to as cookies) or other technologies (Google analytics) are stored on the Customer’s computer. The installation of cookies is necessary for the proper functioning of the Online Store, in particular for the functionalities that require authorization.
- Cookies do not allow the identification of the Customer, nor are they used to process or store personal data.
- The customer has the option of independently changing the settings for cookies in his web browser.
- Detailed information on cookies can be found in the Cookies Policy available in the Websites tab.
Final Provisions
§11
- All rights to the Website, as well as the materials (photos, texts, graphics and other files) placed on the Website are reserved. Without the consent of the copyright holder and the author of the Online Store, no part of this publication may be reproduced, copied, reproduced, distributed or stored in search systems or placed on another website. It may not be transmitted in any form or by any means, electronic, mechanical, photocopiers, CDs or other technologically available means..
- In matters not covered by these Regulations, the provisions of Polish law shall apply.
- Settlement of any disputes arising between Luxury Apartments and a Guest who is a Consumer shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure. Nadmorski LuksuApartments also informs the Consumer that it is possible to use extrajudicial means of settling disputes and pursuing claims, including arbitration, mediation and arbitration, the rules of conducting and access to procedures of which are determined by the appropriate means of arbitration, mediation and arbitration and in accordance with separate regulations.
- Resolution of specific disputes between Luxury Apartments and the client, who is not a Consumer is subject to the court having jurisdiction over the registered office Luxury Apartments.
- None of the provisions of the Regulations does not limit the Consumer’s rights under the applicable law in the territory of the Republic of Poland. In case of establishing existence postanowienia naruszającego te uprawnienia, the provisions of the law in force in the territory of the Republic of Poland apply, in particular the Civil Code and the Act of May 30, 2014 on Consumer Rights (Journal of Laws of 2014, item 827).
- Proper use of the services provided via the Website requires an ICT system that meets the requirements listed below:
- active email account;
- a device with access to the Internet with a properly configured browser;
- the current version of the web browser;
- Luxury apartments Apartments may amend the Regulations, under the conditions indicated below. The change enters into force within 14 days from the date of posting information about the change to the Regulations on the main page of the Website and notifying Guests who have Accounts about its change via e-mail. The use of the Account by the Consumer after the amendment to the Regulations requires acceptance of the Regulations in the amended content. However, the amendment to the Regulations does not apply to reservations made on the Website before its entry into force.
- The current Regulations are published on the Website and delivered free of charge to the Guest (by electronic means) at his every request. The Customer may access these Regulations at any time via the link on the website www.nadmorskiluksus.pl and download it and print it out.
- The Regulations come into force on 30.04. 2018 and applies to Orders placed after that date.
